Terms & Conditions of Sale

By placing an order with Lund London using your trade account you are agreeing to the following terms and conditions

 

Order Minimums and Carriage

All prices displayed on our price list and wholesale site are excluding VAT. All prices are subject to change.

All orders to be delivered are required to meet a minimum order value of £/€/$150 (excl. VAT/sales tax). This is the same for all first and repeat orders.

 

Delivery within the UK

Carriage within the UK (covering shipping and handling) is charged at £15.00 (excl VAT). VAT will be added to all invoices.

Please note that there may be a surcharge for any collections or deliveries to areas considered an extension to mainland UK by our courier, including the Highlands, Channel Islands and other offshore islands.

Delivery is within 5 working days. Please note that we reserve the right to amend this lead time during busy period.

 

Delivery within the EU

Shipping costs for deliveries within the EU will be added to your invoice/at checkout, unless otherwise requested and agreed. If ordering on the website, shipping will be added to your order total. If your country is not listed in the available countries at checkout, or if you prefer to arrange collection and delivery using your preferred carrier, then please contact Lund@lundlondon.com before completing the order.

 

Shipment to EU countries will be from our Netherlands warehouse.

 

We require you to provide a valid VAT/ TVA/ USt-IdNr (or equivalent) number when placing your order. On receipt of your number, it will undergo validation via https://ec.europa.eu/taxation_customs/vies/ Without this number, the UK sales tax will be applied to your invoice, but it can be amended if we receive a valid number before payment.

 

If ordering through the website, an additional invoice will be sent for the tax on the ordered items and this must be paid before dispatch unless a valid number is obtained prior to dispatch.

 

Delivery to the United States & Canada

Shipping costs for deliveries within the United States & Canada will be added to your invoice/at checkout, unless otherwise requested and agreed. If ordering on the website, shipping will be added to your order total. 

Shipment to USA & Canada will be from our Indianapolis warehouse. Shipping charges are based on standard UPS shipping zones eminating from our warehouse in Indianapolis. 

Delivery to the Rest of the World

Shipping costs for deliveries to the rest of the world will be added to your invoice, unless otherwise requested and agreed. If ordering on the website, shipping will be added to your order total. If your country is not listed in the available countries at checkout, or if you prefer to arrange collection and delivery using your preferred carrier, then please contact Lund@lundlondon.com before completing the order online.

 

Import Requirements

All documents and charges relating to the importation of our goods to the customer’s delivery destination are the sole responsibility of the customer. It is the customer’s responsibility to check if their country of delivery requires fumigation of wood products. We will not cover any costs incurred in order for delivery to comply with local customs and import regulations.

 

Order

Any order placed by the customer shall constitute an unconditional offer by the customer to purchase the goods specified in the order. Once the order is received by Lund London it cannot be amended or cancelled without prior written agreement from Lund London.

The price as stated in the order is a fixed price for the entire performance of the contract in relation to the goods concerned. No variation to the price will be permitted unless agreed by Lund London Ltd and obtained by the customer in writing.

The order is a legally binding contract between Lund London Ltd and the customer.

 

Payment

Invoices are issued on a pre-pay basis for all first orders. Credit may be considered if requested and will be considered for all subsequent orders but is agreed at Lund London’s discretion. Before credit can be agreed customers are required to complete a new credit account form and will be subject to a credit check with Lund London’s nominated credit agency.

 

If customer credit is granted we will then dispatch the goods which are immediately available and invoice for payment within our standard credit terms of 30 days from delivery. If the date of payment falls on a day which is not a working day for banks in London (other than a Saturday or Sunday), then the date for payment will be the next working day.

If customer credit is rejected, we will send a pre-pay invoice for the goods, which must be paid before goods can be dispatched.

We reserve the right to terminate any trading agreements and will charge interest inline with statutory UK law:

  1. As set out in the European Directive 2011/7/EU on combating late payment in commercial transactions, if you have not settled all the outstanding amount by the date mentioned above, we regret to inform you that we will charge statutory interest which is annually 8% above the Bank of England base rate from the date that your invoice was due, along with the statutory

 

  1. It will be passed to our Legal Department for litigation and referred to a debt recovery agency acting for and on behalf of Lund London, who will seek recovery of the full principal sum, penalty and interest, and to whom all communication and payment will need to be

 

For orders placed in Euros or US dollars, payment must be made directly to Lund London’s Euro or USD Bank Account as advised on the invoice, or by credit card (subject to a maximum threshold). Any international bank charges must be paid for by the customer. In addition, any fines or charges incurred by banks or couriers as a result of order or payment errors will be the responsibility of the customer.

 

Lund London will not accept any Force Majeure claims.

 

Discount

Any discounts must be agreed with Lund London Ltd prior to the placing of an order. Once the order is received and agreed by Lund London Ltd no additional discounts will be applied after this time.

 

Discounts cannot be applied to any orders retrospectively.

 

Images

Images, including lifestyle images, may be used for your own website/store purposes. These can be found at www.lundlondonmedia.com.

Any photography taken by the customer using our products can be used by Lund London on our website, social media and media drive. By sharing photography with our products in, you are consenting to our use of them.

 

Copyright

We take copyright issues very seriously and have designs registered with the UK IPO and WIPO. Lund London and By Savvy are registered trademarks in addition to additional trademarks on our brands and slogans. If any company is found to be in breach of the law regarding Design and Trademark Rights legal action will be taken.

 

3rd Party Websites

To protect our customers, trade customers are allowed to list our products on their own website. Listing our products on 3rd Party websites, such as Amazon or Ebay, is strictly prohibited.

 

Risk

Goods are transported at the risk of the customer in all cases. Any breakages / damages / discrepancies must be notified to us within 14 days of receipt. We cannot accept responsibility for the non-arrival of this notification within the specified time.

 

In spite of delivery having been made, property of the goods shall not pass from the Seller until the Buyer has paid the price plus VAT in full; and any other sums whatever shall be due from the Buyer to the Seller.

 

Distributors

Acceptance of the T&C’s on payment of an invoice, also deems acceptance that the customers’ contact details can be shared with our designated and approved distributer, in the circumstance that a distributing company should take control of a market/region.

 

Returns

Faulty or Damaged Items within Mainland UK

If your order is faulty or damaged please email lund@lundlondon.com within 14 days of receipt, stating your order number, product number, a description of the fault, images where possible and state whether you would like a replacement or a credit to your account.

If your return is authorised we will send you a Returns Authorisation Number (RAN) as well as the return shipment address. We strongly advise that youreturn the goods to us using a tracked service as we take no responsibility for goods in transit. Return postage is the buyers responsibility. We will arrange credit to your account once returned items have been received. The goods must be returned in their original packaging and in re-sellable condition.

 

Faulty or Damaged Items Outside of Mainland UK

If your order is faulty or damaged please email lund@lundlondon.com within 14 days of receipt, stating your order number, product number, a description of the fault and images where possible. For orders delivered outside of mainland UK, faulty or damaged items will not be replaced but issued with a credit note, which will remain on the customer account for future orders. When e-mailing to advise of any faults or damages please try to include images for reference.

 

Credit Notes

All credit notes will expire if not used within 12 months.

 

Packaging

We are continually improving our packaging with a greater emphasis on eco-friendly materials. We cannot guarantee that you will receive new packaging with all orders.

 

Miscellaneous

Our products are sold in full carton quantities, orders must be in multiples of full carton quantities. Any orders not meeting this requirement will be amended before dispatch and an additional invoice will be raised for additional units. Carton quantities can be found on the price list against each stock code listing and in the additional information under each website listing.

If an ordered product has sold out, we will replace it with an alternative item. This will be at our discretion, but we will endeavor to replace it with the most similar product available.

 

Contract Details – General T&C’s

  1. The contract between us

Any order placed by the customer shall constitute an unconditional offer by the customer to purchase the goods specified in the order. Order of the goods represents a contract on your part to purchase the goods, which will be accepted by us upon receipt.

Please note all products on our website are sold empty and sold individually. Images with

 

additional products in or images of several products are to show possible uses and configurations only.

  • Ownership of rights

All rights, including copyright, on the website are owned by or licensed to Lund London Ltd. Any use of the website or its contents, including copying or storing it or them in whole or part, other than for otherwise agreed use, is prohibited without our permission. You may not modify, distribute or repost anything from the website for any purpose without permission from Lund London.

 

  • Accuracy of content

We have taken care in the preparation of the content of the website, in particular to ensure that prices quoted are correct at the time of publishing and that all goods have been described accurately. Any weights, dimensions and capacities given about the goods are approximate only.

 

  • Damage to your computer

We try to ensure that the website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it will not cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website. Except in the case of negligence on our part, we will not be liable to any person for any loss or damage which may arise to computer equipment as a result of using the website.

 

The website, any content contained therein and any contract brought into being as a result of usage of the website are governed by and construed in accordance with English law.

 

  1. Acknowledgement of your order

To enable us to process your order, you will need to provide us with correct contact details including e-mail address. We will notify you by e-mail as soon as possible to confirm receipt of your order and to confirm details and send invoices where necessary.

 

  1. Availability

All orders are subject to acceptance and availability. Once the order is placed it constitutes an unconditional offer by the customer to purchase the goods on the order. Once received by Lund London the order cannot be amended or cancelled. If the goods you have ordered are not available from stock, we will contact you by e-mail or phone (if you have given us details). Where delivery dates or times are not expressly declared as fixed in our written order confirmation these are to be regarded as estimates. We reserve the right to withdraw any item from sale at any time.

We are entitled to make partial deliveries providing each delivery meets the MOV as stated, with back orders being sent out as soon as stock becomes available.

 

  1. Price

All prices on our price list and website are exclusive of VAT at the current rates unless otherwise stated, and are correct at the time of entering information.

Where it is not possible to accept your order to buy goods of the specification and description at the price indicated, we will advise you by email. We will offer to sell you the goods of the specification and description at the price stated in the email and will state the period for which the offer or the price remains valid.

We reserve the right to alter prices at any time.

 

  1. Payment Terms

All orders will be pre-pay unless agreed otherwise. Credit may be considered on request at Lund London’s discretion. You will be required to complete a new credit account form and will be subject to a credit check with Lund London’s nominated credit agency. Lund London will advise if successful.

If you fail to fulfil payment within the agreed credit terms this will result in all future orders reverting to pre-pay. No further orders will be delivered until outstanding over due payments are received. Lund London accepts no liability if delivery is delayed due to monies owed.

If ordering through the website we will take payment upon receipt of your order from your credit or debit card. We accept no liability if a delivery is delayed because you did not give us the correct payment details. If it is not possible to obtain full payment for the goods from you, then we can refuse to process your order and/or suspend any further deliveries to you. This does not affect any other rights.

    • We are only responsible for losses that are a natural, foreseeable consequence of our breach of these terms and conditions. We do not accept liability if we are prevented or delayed from complying with our obligations set out in these terms and conditions by anything you (or anyone acting with your express or implied authority) does or fails to do, or is due to events which are beyond our reasonable

 

  • Furthermore, we do not accept liability for any losses related to any business of yours

 

including but not limited to: lost data, lost profits, lost revenues or business interruption.

 

  • It is the customer’s responsibility to ensure all products ordered are compliant with legislations in countries intended for sale of goods. Lund London will not take responsibility for unsold goods and will not accept returned goods

 

  • You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from us. The importation or exportation of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you

 

  • Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence. You have certain rights as a consumer including legal rights (e.g. under the Act) relating to faulty and/or mis- described

 

  • Notices

Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to our contact email address at lund@lundlondon.com and all notices from us to you will be displayed on our website from time to time.

 

  • Changes to legal notices

We reserve the right to change these terms and conditions from time to time and you should look through them as often as possible.

 

  • Law, jurisdiction and language

The formation, existence, construction, performance, validity and all aspects of these Conditions and Contract shall be governed by English law and the parties submit to the exclusive jurisdiction of the English courts. The customer agrees to waive any objection that it may have to that jurisdiction or any claim that it is an inappropriate jurisdiction All contracts are concluded in English.

 

  • Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

 

  • Privacy

You acknowledge and agree to be bound by the terms of our privacy policy.

 

  • Third Party Rights

Nothing in this Agreement is intended to, nor shall it confer any rights on a third party. Our terms and conditions of trade are subject to change at any time.

 

By placing an order on the website, by e-mail or by telephone you are accepting these terms and conditions.

 

Failure to comply with these terms may result in termination of our contract and Lund London Ltd will reserve the right to recover any and all costs it incurs as a result of failure to comply.

 

This document is legally binding. The formation, existence, construction, performance, validity and all aspects of these conditions shall be governed by English law.
